About These Terms
These terms apply to commissions and other goods supplied by Celtic Slateworks. “Consumer” means an individual buying mainly for personal use. “Business customer” includes a company or corporation. It also includes a partnership or public body. Charities and clubs are included when buying mainly for organisational purposes.
Enquiries, Quotes and Contract
An enquiry or online preview is not an order. We will confirm the scope and dimensions in writing. The carving method and wording will also be recorded. We will set out the design and price as well as any delivery charge. The expected timescale will be included.
A quotation remains open for the period stated on it. A contract is formed when you accept the quotation and pay the amount requested on the Square invoice. These terms form part of the agreement. The approved design and quotation are also included together with the invoice.
Payment by Square Invoice
Consumers: a 50% deposit is due before materials are committed and carving begins. The final 50% is due when the piece is completed and before dispatch or collection.
Businesses and corporations: 100% of the quoted total is payable upfront before materials are committed, design work is finalised or production begins.
All payments are requested by direct Square invoice. We will show any delivery charge or optional mounting before payment. Special materials and other costs will also be listed. An order is not scheduled for production until the required payment has cleared.
Design Approval
A digital preview is a guide. The written final proof is the production design. Please check names and dates carefully. Check the spelling and measurements too. Make sure the layout and orientation are correct. Please also check the fixing method and all other details.
Production begins only after written approval and the required payment. Changes requested after approval may affect the price and completion date. We will explain and agree any additional charge before carrying out the change.
Approval does not affect your rights if the finished product is faulty or damaged. Your rights also remain if it is not as described or is materially different from the approved design.
Customer-Supplied Content
You confirm that supplied photographs and logos may lawfully be used for your commission. This also applies to badges and artwork as well as wording or other material. Supplied content must not infringe another person’s rights. We may refuse material that is unlawful or abusive. Unsuitable material may also be refused.
You remain responsible for the accuracy of content you supply and approve. Low-quality reference material may limit the detail that can be reproduced. We will raise material concerns before approval where reasonably possible.
Designs and Intellectual Property
Original concepts and drawings created by Celtic Slateworks remain our intellectual property unless agreed otherwise in writing. This also applies to templates and carving designs. Buying the finished physical piece does not transfer the right to copy or reproduce our design. It does not permit manufacturing from the design or commercial use. Your pre-existing rights in supplied content remain yours.
Natural Slate and Hand Carving
Slate is a natural material. Colour and grain vary. Thickness and texture may also differ. Cleavage lines and natural edges form part of its character. Relief and V-carved pieces are made individually. Minor differences from photographs or digital previews are therefore not normally faults. A material difference from the description or approved design will be assessed under your legal rights.
Timing and Delivery
Any completion or delivery date is agreed in writing. Times may change if approval or information is delayed. Late payment may also change the timescale. Circumstances outside our reasonable control may affect materials or production. Delivery can also be affected. We will tell you promptly if a significant delay arises and discuss a fair solution.
Orders are packaged for fragile transit and normally sent using tracked delivery. Please inspect the parcel promptly and keep all packaging if damage is suspected. Risk in a consumer order passes when the goods are delivered to you or a person you nominate.
Cancellation and Deposits
Contact us immediately if you wish to cancel. If production has not started and no special materials or non-recoverable work have been committed, a consumer cancellation will receive a full refund.
The normal change-of-mind cancellation right may not apply once work on a personalised order has begun. If a consumer cancellation is accepted then we will retain only a fair amount for completed work and committed materials. We may also retain unavoidable losses. Any remaining balance will be refunded.
Business customers do not receive consumer cancellation rights. A business cancellation or change is effective only when agreed by us in writing. Any refund will take account of completed work and committed materials. Reasonably incurred losses will also be considered.
Faults, Damage and Returns
Nothing in these terms limits your statutory rights. Contact us as soon as possible if an item is faulty or damaged in transit. Please also contact us if it is not as described or differs materially from the approved design. Include the order details and clear photographs. Our Responsibility
We do not exclude or limit liability where the law does not allow it. This includes liability for death or personal injury caused by negligence. It also includes fraud and your statutory rights concerning faulty or misdescribed goods.
For consumers we are responsible for losses that are a foreseeable result of our breach. We are not responsible for business losses arising from a consumer order. For business customers our total liability arising from an order will not exceed the total price paid for that order. This limit does not apply where liability cannot legally be limited.
Privacy, Changes and Contact
Personal information is handled as described in our Privacy Policy. We may update these website terms for future orders. The version forming part of an existing order will not be changed without agreement.
These terms are governed by applicable UK law. Consumers retain any mandatory rights to bring a claim in the part of the United Kingdom where they live.
